Dear Ms. Nargele:

I am in receipt of the Navyís August 18, 2008 decision on my client, Bruce Henionís request for a fee waiver.† In this letter the Navy revises the cost estimate for the requested records to be $450.

Mr. Henion remains interested in these records.† However, he also seeks all ship logs for Wasp (CVS-18), former CVA-18, CV-18 & Oriskany that are in your possession.† Will you please estimate the cost of these ship logs so that Mr. Henion can make only one payment for the requested material.

Dear Mr. Hodes:

 

This is in response to your Freedom of Information Act (FOIA) appeal of May 37, 2007, on behalf of your client Bruce Henion. We apologize for the delay in responding.

 

Your initial FOIA request of April 26, 2007, asked for access to Navy deck logs for 29 ships, covering various time periods. In our reply of May 21, 2007, we informed you that the deck logs in question were among files that are open and available to the public. We further informed that we would be pleased to make the records available to Mr. Henion or his representative in the research room at the National Archives and Records Administration (NARA) in College Park, Maryland. You construed that response as a denial under the provisions of the FOIA. Your appeal requests that I remand your initial request back to the National Archives FOIA Office for processing of the materials responsive to your clients request.

 

Your appeals states that your client is not asking NARA to conduct research on his behalf rather he is seeking access to specific documents which are outlined in his initial request. Please be advised that NARA maintains approximately 6,980 cubic feet (each cubic foot contains approximately 2,000 - 3,000 pages) of Navy deck logs among the records in Record Group 24, Records of Naval Personnel, covering the time periods referenced in your client's initial request.

 

Deck logs created before 1951 are maintained in bound volumes, subsequent deck logs are comprised of loose textual documents maintained in archival boxes. In order to locate all of the deck logs your client has requested NARA staff would have to locate the volumes or boxes which relate to a particular naval vessel, then search through each page to locate the portion(s) of the log that is of interest to him. Considering our staffing levels and work load, it would be an overwhelming task to under take the research necessary to search for and segregate out those ship logs that are interest to your client.

 

As we informed you previously, N ARA is not staffed to conduct extensive research, but rather to provide guidance to assist researchers in conducting their own research. Further, the FOIA does not require agencies to conduct research in order to respond to FOIA requests. Therefore, I affirm the determination made in our initial response.

The deck logs that Mr. Henion has requested have no restrictions on access. M r. Henion or his representative may gain access to these records at our facility in College P ark.

 

Please contact our Modern Military Records Branch in Room 2400 at the address above, to make arrangement so view these records.

 

You have exhausted your administrative remedies. You may seek judicial review in the United States District Court for the judicial district in which you reside, the District of Columbia, or the District of Maryland, which is where the records are located.
